Pasal 346

ARICLE 346

Article 346 of the Indonesian Penal Code (Kitab Undang-Undang Hukum Pidana) stipulates that “A woman who intentionally terminates or aborts her pregnancy or orders another person to do so is liable to a maximum imprisonment of four years.”

This law presents a moral and legal dilemma for women facing unwanted pregnancies. While there are specific criteria under which abortion is permitted, it doesn’t entirely grant women full control over their own bodies, particularly for married women who do not wish to proceed with a pregnancy.

The intent of this artwork is to emphasize the importance of consent in sexual agreements, which should be mutually agreed upon by both parties without coercion, whether the individuals are married or unmarried. If a woman faces an unwanted pregnancy, she often finds herself caught between the provisions of Article 346 or giving birth under distressing circumstances. This work seeks to shed light on the need for open dialogues and a more comprehensive approach to women’s reproductive rights, emphasizing the significance of consent and informed decisions in matters of reproduction and sexual health.
